Marijuana in South America

By Castulo Zane

South American cannabis laws vary from place to place. Considering how many people and countries are involved this is not surprising. Here is a summary.

Argentina: Marijuana is legal in small amounts and for personal usage. It is also legal to consume on private property and private locations. Consumption in public is tolerated. Medicinal marijuana use is accepted but not legal, except in private locations. Large scale cultivation, sale and transport is illegal and punishable by laws.

Bolivia: Cannabis use and possession is against the law. Possession of large amounts results in long prison terms. Meanwhile, coca use is widely accepted.

Brazil: Possession and cultivation for personal use has been De-penalized. The law mandates a warning, drug education and community services for those caught in possession of personal amounts. Larger scale production is illegal.

Chile: Consumption on private property is legal. Consumption by groups, however, is illegal. Cultivation is legal with a permit. Medical marijuana is unregulated and legal.

Colombia: While officially illegal in amounts of more than 1 gram, law enforcement is not strict. Growing marijuana plants is illegal. Selling is also illegal. Drug law enforcement is lax, however.

Ecuador: Cannabis possession is legal, but restricted to 2 joints. Plant growing is against the law. Sale of marijuana is also illegal.

Paraguay: Marijuana is illegal in Paraguay. However, Paraguay is reportedly one of the largest marijuana producers in South America. Possession of small amounts is not treated harshly.

Venezuela: Marijuana possession is illegal in Venezuela, and punishment is left to the discretion of the judge. Drug treatment is mandated by the court. Simple possession for personal use is tolerated. Trafficking is illegal.

Marijuana laws vary across the continent. Trafficking and cultivation for sale is usually illegal. Medicinal use is sometimes permitted. Enforcement varies as well, with some laws being virtually ignored in practice.
